Zusammenfassung:eng: In entering the third stage of the economic and monetary union the Euro has been established as the official currency in Austria as from January 1st 1999. From this date on everyone is affected by this measure in their daily economic transactions. The Euro will have an impact on all legal relations expressed in monetary sums or having monetary content. The Austrian provisions enforcing the Schilling as the official Austrian currency will be amended to allow replacement by the Euro. This essay examines the current legal basis for expenditure in Austria, comparing it to the legal basis of the European regulations implementing the Euro, and its surroundings of the treaty of the European Community. Moreover, it will examine the admissibility of the interference with the national civil law systems. The second part of this paper takes a look at the Austrian civil law system and argues, whether it offers solutions for issues occurring out of a change of currencies. Furthermore, it will be examined, whether and to which extend a change of currencies has further impact on valid valuation clauses and interest rates. As a result of the experiences with the galloping inflation and currency depreciation in between the two World Wars and the monetary reform after World War II the Austrian legal system is well prepared for the change from Schilling to Euro. Besides civil remedies will not be applicable for clear judicatural reasons. The establishment of the monetary union does not cause unforeseeable dangers, but offers a huge chance for a prosperous Common European Market.
