Zusammenfassung:eng: The treatise deals with the problem of developing a genuine European consumer law. It follows up the question how consumer protection activities could be based upon the existing base of competence. The study shows the dynamical evolution and interpretation of competence rules from the Treaty of Rome to the Treaties of Maastricht and Amsterdam. As a first result can be stated that - in spite of the lack of notion of special consumer rights in the Treaty of Rome - consumer interests were stronger and stronger articulated in the course of time. The outpointed lack of competence and even some competence conflict, were outweighed by a dynamical understanding of the European Union, which was no longer only fixed on economical progress but also took into account social considerations. Consumer law was more and more understood as an important part of commercial law. The special part of the treatise occupies on the contractual consumer directives taking into consideration the development of a genuine European consumer definition. Therefore all existing contractual directives dealing with consumer rights (existing at the time of the study) were examined. It came out as a result that there is no uniform, standardized consumer definition. But a core-definition could be extracted from the various directives. A consumer is a natural person not contracting for a commercial purpose. The outstanding concept to grant consumer protection is to allocate enough and adequate information. Generating information is the main issue of European consumer law and corresponding to that the main source of influence on national standards.
