Zusammenfassung:eng: This analysis focuses on the legal condition of expulsion and extradition in the case that an alien is subjected to torture or to inhuman or degrading treatment or punishment. Persons are protected from expulsion in the case of a 'real risk' of ill-treatment. If , however, a person gets expelled, the expulsive state has to take over the responsibility for the treatment of the Human Rights. The most effective protection of the non-refoulement principle within the International Law is provided by Article 3 of the European Convention on Human Rights.<br />This Article 3 is valid without any restriction. That means that the protection exists for all human beings and cannot be restricted by the state legislation. Comparable with the Article 3 of the European Convention on the Human Right there are further articles in international treaties which the contracting states have to stick to.<br />The contracts of Schengen, Dublin and Maastricht do not agree in all respects with the demands of Article 3 of the European Convention on Human Rights. This is also valid for the Austrian 'Fremdengesetz' and 'Asylgesetz'. The principle of non- refoulement forms a legal maxim of International Law and presents ius cogens.
