| Zusammenfassung: | eng: The goals of liability regulations for prescription drugs and medical products are to examine the production, use and supervision of such products in the past decades as well as to increase protective measures for those in need of medication. The fact is that there are numerous medical products that cannot be approved, with the current level of knowledge, for their designed purpose. Therefore, efforts are being made to establish more stringent criteria for drug approval, as well as tighten liability regulations for defective prescription drugs in order to increase the reliability of medical products. This report first examines and compares prescription drug and medical product liability in Austria and Germany and then describes efforts being made within the European Community to coordinate these policies. Secondly, it deals with the Austrian and German medical product/prescription drug laws that were agreed upon as a result of adjustments to comply with EC guidelines. This report deals with an extremely complicated topic because of the large number of medical products available. The goal of this report is to shed some light on the comprehensive topic of prescription drug reliability and its related problems. |
