Zusammenfassung:eng: The doctoral thesis examines the protection of foreign investment against political risks or non-commercial risks, i.e. the risk of expropriation, of war and civil disturbance and the transfer risk, offered by the Multilateral Investment Guarantee Agency (MIGA), an international organization and member of the World Bank Group. It discusses the economic background of foreign investment, the legal relations between host and home country, investor and insurer and the successful creation of MIGA in 1985, after a number of failed attempts.<br />The study covers MIGA's organizational framework and its relation to other international organizations and governmental and private insurers of political risks. It compares in detail MIGA's guarantee and the investment guarantee (Beteiligungsgarantie) issued by the Oesterreichische Kontrollbank on behalf of the Austrian Republic.<br />Finally, MIGA's role in the development of procedural and substantive protection of foreign investment under international law is analyzed.<br />The study finds that the flow of foreign investment, particularly foreign direct investment (FDI), to the Third World and its importance for the development process have increased. Thus, mechanisms for the protection of foreign investment against political risks have also become more important. The insurance offered by governmental and private entities and MIGA is one way to cover a project against political risks.<br />MIGA has the potential to complement existing insurers, which sometimes reach the limits of their capacity. The MIGA Convention is also a step in the creation of substantive international law standards in the area of investment protection. An accession of Austria, as one of a few countries that have not joined, is recommended.
