Zusammenfassung:eng: The main object is to examine the consequences which an Austrian accession to the EEC would have with regard to the international regulation of restraints of trade and to the Austrian national cartel law. At present, the cartel law relations between Austria and the EEC are governed by Article 23(1)(1) of the Free Trade Agreement (FTA) of 22 July 1972 (BGBL 486/1972). If Austria joined the Community this provision would be replaced by Article 85 of the EEC-Treaty. In spite of the fact that Art 23(1)(1) FTA is modelled on Art 85 EEC-T, a detailed comparison of these rules shows some substantial differences, for instance regarding the treatment of restrictions of competition in licence contracts. Even more important is that neither the EEC nor Austria have appropriately inforced Art 23(1) (1) FTA in their territories, so that the practical relevance of this provision lags far behind the enormous importance of Art 85 EEC-T. Consequently, the study submits that an Austrian accession to the EEC would considerably intensify the control of cartels which affect Austria's trade with the Community. On top of this, it is to be expected that Austria's national cartel law would lose a lot of its present importance, as the European Court of Justice applies Art 85 EEC-T not only to international, but to a large extent also to national restrictions of competition.
